Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the HighlightIQ browser extension ("Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must uninstall the extension and discontinue use immediately.

These Terms constitute a legally binding agreement between you and EnigmaxTech ("Company," "we," "our," or "us"), the developer of HighlightIQ.

2. Description of Service

HighlightIQ is a browser extension that allows you to:

• Highlight and save text on any web page
• Add annotations (notes) to highlights
• Organize highlights with tags
• Search, filter, and export your highlights
• Sync highlights across devices (when signed in)
• Use AI-powered contextual definitions

3. Account and Authentication

3.1 Google Sign-In

To use HighlightIQ, you must sign in using your Google account. By signing in, you authorize us to receive your basic profile information (name, email, profile picture) from Google for authentication purposes.

3.2 Account Responsibility

You are responsible for maintaining the security of your Google account. You agree to notify us immediately if you suspect unauthorized access to your HighlightIQ data. We are not responsible for any loss or damage arising from unauthorized access to your account.

3.3 One Account Per User

Each Google account corresponds to one HighlightIQ account. You may not create multiple accounts for abusive purposes.

4. User Content and Data Ownership

4.1 License to Provide the Service

By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of providing, maintaining, and improving the Service (e.g., syncing your data across devices, displaying it in the extension UI). This license terminates when you delete your data or account.

4.2 Content Restrictions

While we do not monitor your content, you agree not to use HighlightIQ to:

• Store or transmit content that violates any applicable law
• Infringe upon the intellectual property rights of others
• Store malicious code, viruses, or other harmful data
• Engage in activities that disrupt or compromise the Service

4.3 No Use for AI Training

We will never use your content, highlights, annotations, or any user-generated data to train, fine-tune, or develop any artificial intelligence or machine learning models. This is a binding commitment under these Terms.

5. Data Protection and Privacy

Your privacy is important to us. Our data handling practices are detailed in our Privacy Policy, which is incorporated into these Terms by reference. Key commitments include:

• We do not sell, share, or trade your data with third parties
• We do not use your data for advertising
• We do not use your data to train AI/ML models
• Your data is encrypted in transit and at rest
• You can delete all your data at any time

6. Data Deletion and Account Termination

6.1 Your Right to Delete

You may delete your account and all associated data at any time using the "Delete Account" option in the extension Settings. Upon deletion:

• All your data on our servers will be permanently and irreversibly deleted within 30 days
• Local data on your device will be cleared immediately
• This action cannot be undone

6.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service if:

• You violate these Terms
• Your use of the Service poses a security risk
• Required by law or court order

If we terminate your account, we will make reasonable efforts to provide you an opportunity to export your data before deletion, unless prohibited by law.

7. AI Define Feature

The AI Define feature sends selected text to an AI service provider to generate contextual definitions. By using this feature:

• You acknowledge that the selected text will be transmitted to a third-party AI provider
• The AI provider does not retain your data after generating the response
• Definitions are provided "as-is" and may not always be accurate
• You should not rely on AI-generated definitions for critical decisions (medical, legal, financial, etc.)

8. Intellectual Property

8.1 Our Intellectual Property

The HighlightIQ extension, including its code, design, logos, and documentation, is the intellectual property of EnigmaxTech and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written consent.

8.2 Open Source Components

HighlightIQ may include open-source software components, which are subject to their respective licenses.

9. Service Availability and Modifications

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may modify, update, or discontinue features of the Service at any time.
• We will make reasonable efforts to notify users of significant changes.
• Local highlighting functionality works offline; sync and AI features require an internet connection.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied.
• We do not warrant that the Service will be error-free, secure, or available at all times.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the Service (if any) in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless EnigmaxTech, its affiliates, and their respective officers, directors, and employees from any claims, losses, or damages (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be resolved through:

1. Informal resolution: We encourage you to contact us first to resolve any disputes amicably.
2. Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EnigmaxTech regarding the use of HighlightIQ and supersede all prior agreements and understandings.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and may notify you through the extension. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
